End User License Agreement

1. License grant

The operator of NOX ("Licensor") grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software for your own non-commercial or internal business use, subject to this EULA and to the NOX Terms of Service and Privacy Policy.

2. Restrictions

You may not:

• Copy, modify, or create derivative works of the Software.
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Software, except to the extent this restriction is prohibited by applicable law.
• Rent, lease, sell, sublicense, distribute, or transfer the Software to any third party.
• Remove or alter any copyright, trademark, or other proprietary notices contained in the Software.
• Use the Software to build or train a competing product.
• Use the Software in violation of any law in your jurisdiction or the Licensor's jurisdiction.

3. Ownership

The Software is licensed, not sold. Licensor and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted to you except as expressly set forth in this EULA.

4. Third-party components

The Software includes third-party open source components governed by their own licenses. Those licenses are preserved alongside the Software files and take precedence over this EULA for the corresponding components only.

5. Automatic updates

The Software may periodically check for and download updates. You consent to this behaviour. Updates are delivered subject to this EULA; material changes to the EULA will trigger a re-prompt to accept the new version.

6. Data collected by the Software

The Software connects to NOX servers and processes data as described in the Privacy Policy. The Software itself does not contain third-party advertising or behavioural-ad SDKs.

7. Termination

This EULA is effective until terminated. Licensor may terminate this EULA immediately if you breach any of its terms. On termination you must stop using the Software and remove all copies. Sections 2, 3, 8, 9, 10, and 11 survive termination.

8. Disclaimer of warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, Licensor disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Use of the Software is at your own risk.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Licensor shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Software. Licensor's total cumulative liability shall not exceed the greater of (a) the amount you have paid for the Software in the twelve months preceding the claim (which, for a free download, is zero) or (b) USD 100.

10. Export control

You agree to comply with all applicable export and re-export control laws. You represent that you are not located in a country subject to a comprehensive U.S. or EU embargo and that you are not on any restricted-parties list.

11. Governing law

This EULA is governed by the laws of the operator's country of residence, without regard to conflict-of-laws principles. The current governing jurisdiction is listed on the homepage.

12. Entire agreement

This EULA, together with the NOX Terms of Service and Privacy Policy, constitutes the entire agreement between you and Licensor regarding the Software. If any provision is held unenforceable, the remaining provisions remain in force.
